Under the Nuclear Safety and Control Act and associated regulations, various levels of regulatory action can be taken by the Canadian Nuclear Safety Commission (CNSC) to protect the health, safety and security of Canadians and the environment.

Federal Court decision rendered on Enviropac

In 2008, the CNSC took possession of all nuclear substances and prescribed equipment located at Enviropac, at 2236 80th Avenue in Edmonton, Alberta. An application to the Federal Court was filed by the CNSC on December 20, 2010, to seek approval to dispose of all materials seized.

On June 9, 2011, the Federal Court, upon consideration of the matter, granted the CNSC an order to dispose of the nuclear substances and prescribed equipment seized, in a manner and timing which is deemed appropriate by the CNSC.

With this federal court order, the CNSC is permitted to send the nuclear substances and radiation devices for disposal at a licensed waste management site.

Commission Tribunal revokes order issued to E. Kolewaski

Following the remediation process of the premises located at 2236 80th Avenue in Edmonton, Alberta, CNSC staff concluded that the radiological criteria for the site have been met. On October 9, 2008, upon the recommendation of CNSC staff, the Commission Tribunal revoked the order issued to E. Kolewaski.

Following an additional recommendation from CNSC staff that the company remains unqualified to carry on the activities that its licences authorize, on October 9, 2008, the Commission Tribunal also revoked three licences issued to 588972 Alberta Ltd., operating as Enviropac.

Commission Tribunal confirms order issued to E. Kolewaski

A panel of the Commission Tribunal was established to review the April 3 order issued to E. Kolewaski. Following its review, the Commission Tribunal confirmed that based on existing evidence, there was a reasonable basis for issuing the order.

CNSC announces order issued to E. Kolewaski

On April 3, 2008, the CNSC issued an order to E. Kolewaski, the landlord of the premises located at 2236 80th Avenue, in Edmonton, Alberta. The order restricted access to the former Enviropac location, due to the identification of radioactive contamination in excess of the normal values allowable for the area. The order was issued because of the potential for an unreasonable risk to the health and safety of persons.

CNSC Announces Decision to Suspend Licences and Replace the Order issued to 588972 Alberta Ltd. and Operated as Enviropac

Following a proceeding held on December 14, 2006 and February 7, 2007, the Canadian Nuclear Safety Commission (CNSC) announced today its decision to suspend in whole the storage, processing and calibration licences issued to Enviropac and to replace the Designated Officer Order issued on September 15, 2006 and confirmed in part by the Commission on December 14, 2006. Enviropac is located in Edmonton, Alberta.
